Who will defend the rights of Canadians under the Charter of Rights and Freedoms? It does not seem to be the case that the Canadian courts wish to do so as on October 22, 2022 the Federal court refused to hear arguments.
Associate Chief Justice of the federal court Jocelyn Gagne dismissed the Peckford Charter challenge (along with the three other related lawsuits) concerning the federal Liberal government’s travel ban against unvaccinated Canadians. The Honourable Brian Peckford is the last surviving signatory to the Charter of Rights and Freedoms (and also Chairman of TBOF).
To be clear, the Judge did not find against Peckford et al. Rather, the federal government requested that the court to refuse to hear the case on the basis of “mootness”. - Taking Back Our Freedoms
The reason we have court cases is to determine guilt or innocence, or so I have been led to believe. We are asking, did the Canadian government exceed its bounds and violate the rights of Canadian citizens when it introduced a travel ban that did not allow unvaccinated persons to travel by air, train or ship? On the matter of “mootness,” due to the ban being lifted, this makes about as much sense to me as saying that since a man discontinued to beat his wife three months ago, there is no longer a case against him for the time he put her in the hospital.
Yes, because mandates are lifted, the court refused to take the case as presented by the Honorable Brian Peckford, one of the drafters of the Canadian Charter of Rights and Freedoms. This is not the first time challenges to the mandates have been refused to be heard in courts. Here is another example. Travel mandates were in place for eight and a half months from October 30, 2021 to June 20, 2022. At that time they were merely “suspended” and could still be brought back.
I’m not a lawyer or a judge. I have limited knowledge of procedures in a court room. Thankfully I’ve never even spent time in court. But this Wednesday I plan to appear in court, if remotely, to find out why Canadian courts refuse to take a case as relevant to all Canadians as the one presented by Mr. Peckford.
Hesitant to go to the Canadian media to announce his original lawsuit Peckford contacted Jordan Peterson who agreed to interview Peckford. The interview was uploaded to YouTube on Jan. 26 and to date has 1.1 million views. This information was found through the Epoch Times.
I am informed that the hearing challenging the refusal to take the case will take place at 6:30 a.m. Vancouver time. I’ve also been instructed not to share the link publicly to keep this webinar secure. However you can register at this link https://cas-satj.zoom.us/webinar/register/WN_VehMKVguTaaZ5YIlZPMN3A#
One of the reasons given for refusing the case was limited interest from Canadians. We as Canadians can change that perception.
Yes it is remarkable and a very sad state of affairs when a man of his stature is spurned by the courts of Canada.
Brian Peckford is a man of integrity, worthy of the utmost honor and respect. He has served our nation, well and is a living treasure we can be proud to call our own. The treatment he is receiving and the disrespect he is been shown by our judicial system is beyond belief. You were appointed to deal with and protect our nation. The lack of coverage on this matter, is yet another nail in the coffin of our nation. It is obvious that the swamp needs to be completely drained.
Thank you for writing about this and being a voice. Canada, we need to stand!
